Candidate Terms of Engagement
Applies to
Permanent & Temporary/Contract Candidates
1. Introduction
These Candidate Terms of Engagement (“Terms”) set out the basis on which Purple Cleaning Services Ltd (“the Agency”, “we”, “us”) will provide recruitment services to you as a candidate (“you”, “the Candidate”).
By registering with the Agency, submitting your CV, or accepting any introduction or assignment arranged by us, you agree to be bound by these Terms. Please read them carefully. If you have any questions, contact us before proceeding.
2. Definitions
“The Agency” means Purple Cleaning Services Ltd, 6 Station Parade, Northolt, UB5 5HR.
“Candidate” means any individual who registers with or is represented by the Agency for the purpose of finding employment or contract work.
“Client” means any business or individual to whom the Agency introduces a Candidate.
“Permanent Role” means direct employment with a Client on a permanent or fixed-term basis.
“Temporary/Contract Assignment” means a placement in which you work for a Client on a temporary, interim, or contract basis arranged by the Agency.
“Assignment” means any period of work arranged by the Agency for a Candidate with a Client.
3. Registration & Candidate Responsibilities
To register with the Agency, you must provide full, accurate, and up-to-date information including:

your identity (including valid photo ID and proof of address);

your right to work in the United Kingdom – you must provide original documents as required by the Immigration, Asylum and Nationality Act 2006;

your qualifications, training, and relevant experience;
-
any professional registrations, certifications, or licences required for the roles you are seeking; and
-
details of any convictions not protected under the Rehabilitation of Offenders Act 1974, where the role requires disclosure.
You agree to notify the Agency immediately of any changes to the above information, including any change in your right to work status, health conditions that may affect your ability to perform a role, or criminal convictions arising after registration.
You warrant that all information provided to the Agency is truthful and accurate. Providing false or misleading information may result in your registration being cancelled and could be reported to relevant authorities.
4. Services Provided by the Agency
The Agency will use reasonable endeavours to:

identify suitable permanent roles or temporary/contract assignments that match your skills, experience, and preferences;

introduce you to relevant Clients where appropriate;
-
provide you with accurate information about any role or assignment before an introduction is made;

advise you of the key terms of any engagement including pay rate, hours, location, and expected duration; and
-
support you through the application and placement process.
The Agency does not guarantee that it will find you employment or that any introduction will result in a placement. Registration with the Agency is free of charge to candidates.
5. Permanent Placements
Where the Agency introduces you to a Client for a permanent or fixed-term role, the employment relationship will be solely between you and the Client. The Agency’s role ends upon commencement of your employment.
You agree not to approach or accept employment directly from any Client to whom the Agency has introduced you within 6 months of that introduction without the prior written consent of the Agency. Where a placement fee would ordinarily have been payable, the Agency reserves the right to seek compensation from the Client in such circumstances.
6. Temporary & Contract Assignments
6.1 Nature of Engagement
Where you are placed on a temporary or contract assignment, the Agency acts as an employment business. You will be supplied to work for the Client under their supervision and direction. This does not create an employment contract between you and the Client.
Each assignment will be confirmed in an Assignment Schedule or booking confirmation which will specify the Client, role, location, start date, anticipated duration, hours of work, and agreed pay rate. You should not commence an assignment without receiving such confirmation.
6.2 Conduct on Assignment
While on assignment you are expected to:

comply with the Client’s reasonable workplace policies, procedures, and rules;

maintain professional standards of behaviour, dress, and conduct;

carry out all duties assigned to you diligently and competently;
-
report any health and safety concerns or workplace incidents to both the Client and the Agency promptly; and
-
not engage in any activity that could bring the Agency or Client into disrepute.
Failure to comply with the above may result in removal from an assignment. Where serious misconduct is involved, the Agency reserves the right to terminate your registration.
6.3 Timesheets
You are responsible for accurately completing your timesheet for each week of an assignment and submitting it to your supervisor at the Client site for authorisation. Timesheets must be submitted to the Agency by the agreed deadline each week. Late or unapproved timesheets may delay your payment.
6.4 Ending an Assignment
Either you or the Agency may terminate an assignment by giving the agreed notice period specified in the Assignment Schedule. Where no specific notice period is stated, a minimum of 1 week’s written notice is required.
If you wish to leave an assignment early, please notify the Agency as soon as possible so that the Client can be informed and alternative arrangements made. Abandoning an assignment without notice may affect your ability to be placed on future assignments.
7. Pay & Holiday Entitlement
7.1 Pay
Your pay rate will be confirmed in writing prior to each assignment. The Agency will pay you for all authorised hours worked in accordance with the agreed timesheet. Payments are made weekly (or as otherwise agreed) by BACS transfer directly to your nominated bank account.
The Agency will deduct PAYE income tax and National Insurance contributions from your pay in accordance with HMRC requirements. You will receive a payslip for each payment.
The Agency will at all times pay at least the National Living Wage or National Minimum Wage applicable to your age group.
7.2 Holiday Pay
You are entitled to 5.6 weeks’ paid annual leave per year (pro rata for part-year workers), in accordance with the Working Time Regulations 1998. Holiday pay is accrued during each assignment and will either be included in your weekly pay (rolled-up holiday pay, where permitted) or paid on request during a period of leave. This will be confirmed in your Assignment Schedule.
7.3 Expenses
Unless expressly agreed in writing in advance, the Agency will not reimburse travel, accommodation, or other expenses incurred in connection with an assignment.
8. Agency Workers Regulations 2010
After 12 continuous weeks working in the same role for the same Client (or a role that is substantially the same), you will be entitled to the same basic working and employment conditions as a comparable employee of the Client. These include pay, working hours, rest periods, and access to collective facilities.
It is your responsibility to inform the Agency of any previous assignments with the same Client that may count towards the 12-week qualifying period. The Agency will keep records to assist with this calculation.
9. Data Protection & Privacy
The Agency is a data controller for the personal data you provide during registration and throughout your relationship with us. We will process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
We will use your personal data to:
-
assess your suitability for roles and make introductions to Clients;

comply with our legal obligations (including right-to-work verification); and
-
maintain records required for payroll and tax purposes.
We will only share your personal data with Clients with your knowledge and for the purpose of a specific introduction. We will not sell your data to third parties.
You have the right to access, correct, or request deletion of your personal data. For full details, please refer to our Privacy Notice, available on request.
10. Confidentiality
During and after any assignment, you must keep confidential all information relating to the Client’s business, customers, employees, and operations that is not in the public domain. You must not use or disclose such information for any purpose other than carrying out your assigned duties.
This obligation survives the end of any assignment and your registration with the Agency.
11. Health & Safety
The Client is responsible for the health and safety of its workplace. Before commencing any assignment, you should satisfy yourself that the working environment is safe. If you have any concerns, raise them with the Client’s supervisor immediately and notify the Agency.
You must follow all health and safety instructions provided by the Client and use any personal protective equipment (PPE) supplied. You must not undertake tasks for which you have not been trained or which you believe to be unsafe.
Any workplace accident, near-miss, or injury must be reported to both the Client and the Agency on the day it occurs.
12. Conduct & Non-Exclusivity
You are free to register with other employment agencies and to seek work independently. However, once you have accepted an assignment from the Agency, you are expected to honour that commitment. Accepting an assignment and then not turning up without reasonable notice causes significant disruption to Clients and may result in your registration being suspended.
You must not solicit, canvass, or approach for employment any of the Agency’s Clients directly during an assignment or for a period of 3 months after the end of an assignment, without the Agency’s prior written consent.
13. Termination of Registration
Either party may terminate the registration relationship at any time by giving written notice. Termination of registration will not affect any ongoing assignment, which will be concluded in accordance with the relevant Assignment Schedule.
The Agency may immediately suspend or terminate your registration if you:

provide false or misleading information;
-
lose your right to work in the UK;
-
engage in serious misconduct on or off an assignment;
-
breach these Terms; or
-
are found to have brought the Agency or a Client into disrepute.
14. Complaints
If you have a complaint about any aspect of the Agency’s service, please raise it in writing with your consultant in the first instance. We will acknowledge your complaint within 3 working days and aim to resolve it within 14 working days.
The Agency operates in compliance with the Conduct of Employment Agencies and Employment Businesses Regulations 2003. You may also refer complaints to the Employment Agency Standards (EAS) Inspectorate at the Department for Business and Trade.
15. General Provisions
15.1 Entire Agreement
These Terms, together with any Assignment Schedule issued to you, constitute the entire agreement between you and the Agency regarding the provision of recruitment services.
15.2 Variation
The Agency reserves the right to update these Terms from time to time. You will be notified of any material changes in writing. Continued engagement with the Agency following notification will constitute acceptance of the updated Terms.
15.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15.4 Governing Law
These Terms are governed by the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Acknowledgement & Acceptance
By registering with Purple Cleaning Services Ltd, submitting your CV, or accepting work through the Agency, you acknowledge that you have read, understood, and agree to be bound by these Candidate Terms of Engagement.
